Hannah Wilson

Introducing our divorce expert – Hannah Wilson

Hannah Wilson

Why did we ask Hannah Wilson to join us as our Divorce Expert

This episode introduces Hannah Wilson. Hannah explains the way she breaks down this huge subject of Divorce into “bite- sized chunks”. So that instead of feeling blindsided, you understand how to consider a divorce settlement which will form the foundation for the future. If you are getting married and want to understand more about the contract of marriage this is also a great place to start

Why are we doing podcasts on divorce

Divorce proof your marriage

This episode explains how we have split up this huge subject and how to navigate your way through the various podcasts. We have seen how Divorce can completely blindside our clients. And how women looking to get married don’t understand the full impact of the marital regime that they marry into. So we decided to create these podcasts, to better prepare all parties in terms of marriage and possibly divorce should this occur. It is a huge topic and so we have decided to break this down into small snippets so you can access the information you want.

Marital Regimes

I am getting divorced! Where do I start?

This episode looks at unwinding the partnership of marriage. It focuses specifically on the unwinding of the financial partnership and understanding that this applies to 3 areas: Division of assets; Possible Child maintenance; Possible Spousal Maintenance.

Division of assets

Who gets what in divorce.

How assets in a marriage are divided on death or divorce

An extremely important episode: How are the assets in a marriage split up, or “Who gets what” starts with which country’s law applied at the day of marriage. Do not just assume this is South Africa. This episode unpacks why and subsequently which marital regime will apply for your marriage. This is an important episode in understanding the division of assets be it through divorce or on the passing of your significant other.

Married in Community of Property

How am I married: In Community of Property

Married in Community of Property: What does this mean, what are the implications of being married under this regime for death or divorce and how do you specifically opt out of this regime. We also discuss how to handle the receiving inheritance whilst married under this regime and why the necessary ringfencing of this is so important.

Married Out of Community of Property with Accrual - Part One

One of the most common marital regimes: “The I owe you”

Married out of Community of Property with accrual. Part 1 What does this mean, what the implications of this are. How do you specifically select this when getting married. Why would you chose this. And of course, how does this affect you when you get divorced. Part 2 is a separate podcast which looks specifically at how to calculate the accrual claim.

Married Out of Community of Property with Accrual - Part Two

The Accrual Claim and how to calculate it

This is part two to our podcast “Married out of Community of Property with accrual”. We break down the very simple application of the accrual claim. But then also look at what might be excluded from this claim like inheritance and donations between spouses.

Out and Out. Probably the cleanest and clearest regime

Married out of community of property and without accrual. The simplest of the marital regimes. This episode explores what the parameters are around this regime and possible elements that one should consider that might be relevant in divorce, like what happens in the case of purchasing a joint property. We also touch on Loans to Discretionary Trusts and how this affects your personal estate in a divorce.

Childs Maintenance

How much do our kids cost and who contributes to this.

How do you calculate how much each parent is going to be contributing to these costs in the post divorce world. We talk about reasonable maintenance requirements and how to consider calculating these actual costs. And finally how each parent is going to contribute proportionality in terms of each parents financial means.

Spousal maintenance

How much am I entitled to request for spousal maintenance

Its a balance between an established need vs the ability to finance that need

So often clients advise that they are entitled to maintenace. This episode looks to unpack what is spousal maintenance and under which circumstances this will be granted by the court. It touches on the fact that spousal maintenance can be revisited. From a finance perspective its where you start to look at lump sum payouts and should consider the advice of a Wealth specialist to help you calculate this as this may very well be a better choice in the long run.
